TERMS OF SERVICE & PARTNERSHIP AGREEMENT

1. AGREEMENT TO TERMS

By accessing the3pinitiative.org (the "Site") and engaging with the services offered by The 3P Initiative, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement concerning your access to the Site, your use of the Community Impact Score™ (CIS), and your participation in the "Community Champion" recognition program.

2. INTELLECTUAL PROPERTY RIGHTS

We take the protection of our methodology seriously. Unless otherwise indicated, the Site and all associated methodologies are our proprietary property. Specifically, the following assets are protected trade secrets and intellectual property of The 3P Initiative:

  • The "Community Impact Score™" (CIS) Algorithm

  • The "Occupational Social Worth™" Standard

  • The "Truth Gap™" Double-Blind Protocol

License to Use: Partners are granted a limited, non-exclusive, revocable license to use the "3P Community Champion" Seal and associated materials solely for the duration of their active agreement. No part of our methodology may be reverse-engineered, reproduced, or resold without express written permission.

3. PARTNERSHIP & SERVICE TIERS

We offer professional recognition and auditing services ("Partnerships"). By executing a Partnership Agreement, you agree to pay the recurring fees associated with your chosen tier.

  • Audit Fees: Fees related to Phase 1 Baselines and CIS Calibration are for professional labor and are fully earned upon receipt.

  • Service Delivery: We commit to providing program administration, government coordination for Proclamations, and media support as described in your specific Service Level Agreement (SLA).

4. SUBMISSIONS & CHAMPION DATA

You acknowledge that any information provided via nomination forms ("Submissions") becomes the property of The 3P Initiative for the purpose of advocacy and public recognition.

  • Warranties: You represent that you have obtained express consent from any individual featured in your Submission (including photos and names) before providing it to us.

  • Usage: You grant us the right to display this information on our Site, social media channels, and in official correspondence with the Governor's Office.

5. DISCLAIMERS & LIMITATION OF LIABILITY

CRITICAL NOTICE REGARDING SAFETY & RISK: The 3P Initiative measures Human Systems Integration and Cultural Engagement. We do not provide regulatory safety inspections or OSHA compliance certification.

  • Not Professional Legal/Safety Advice: The information provided on this Site and through the CIS Score is for informational and cultural assessment purposes only. It is not a substitute for professional legal counsel or a Certified Safety Professional (CSP) audit.

  • No Guarantee of Safety: A high Community Impact Score™ indicates strong cultural cohesion; it does not guarantee freedom from workplace accidents or immunity from regulatory citations. The 3P Initiative assumes no liability for operational incidents, injuries, or citations that occur at a Partner's facility.

6. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your use of the Site; (2) false data submitted during a CIS Audit; or (3) any safety incident occurring at your place of business.

7. CANCELLATION & TERMINATION

You may cancel your partnership at any time by providing written notice to jpruitt@the3pinitiative.org.

  • No Refunds: All fees paid are non-refundable.

  • Termination for Cause: We reserve the right to terminate your agreement and revoke your "Community Champion" status immediately if you engage in conduct that harms the reputation of the program or the Office of the Governor.

8. GOVERNING LAW

These Terms shall be governed by and defined following the laws of the State of West Virginia. Any legal action of whatever nature shall be filed only in the state and federal courts located in Cabell County, West Virginia.
